Terms of Use

Welcome to Birdie! These Terms of Use (“Terms”) govern your access to and use of the Birdie mobile application (the “App”), operated by Birdie Scandinavia ApS (“we,” “our,” or “us”). By downloading, accessing, or using Birdie, you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. Eligibility

• You must be at least 13 years old to use Birdie (or 14 in South Korea, in accordance with local law).

• By creating an account, you represent that you meet this minimum age requirement.

• You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

2. User Accounts

• You may create an account using your email and password or by signing in through Google, Apple, or Facebook.

• You agree to provide accurate, current, and complete information.

• We reserve the right to suspend or terminate accounts if information is inaccurate or if the account is misused.

3. Acceptable Use

You agree not to use the App in any way that:

• Violates applicable laws or regulations.

• Infringes the rights of others, including intellectual property rights.

• Distributes spam, malware, or harmful content.

• Attempts to interfere with the proper functioning or security of the App.

4. Intellectual Property

• The App, including its design, software, and features, is owned by Birdie Scandinavia ApS and protected by copyright and other intellectual property laws.

• Data and information displayed in the App (such as pollen, environmental, or mold risk data) may be provided through third-party APIs and external data sources. We do not claim ownership of such external data, and all rights remain with their respective providers.

• You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

5. Paid Features

Currently, the App is provided free of charge. If we introduce paid features or subscriptions in the future, you will be provided with updated Terms and the option to accept them before purchase.

6. Disclaimers

• The App is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

• While we strive to provide accurate information (such as pollen and environmental data), we make no guarantee of accuracy, completeness, or reliability.

• You use the App at your own risk.

7. Limitation of Liability

• To the fullest extent permitted by law, Birdie Scandinavia ApS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the App.

• Features such as the mold risk indicator and environmental data are provided as estimates only and should not be considered as professional advice or guarantees.

• You are solely responsible for taking appropriate measures regarding your indoor environment. If you suspect issues such as mold, allergies, or other health risks, you should consult a qualified professional.

• We are not responsible for any health problems, damages, or losses that may arise as a result of reliance on data or estimates provided by the App, including cases where the information may be inaccurate or incomplete.

8. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in misuse of the App. You may also delete your account at any time through the App or by contacting us.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Denmark. Any disputes shall be subject to the exclusive jurisdiction of the courts of Copenhagen, Denmark.

10. Changes to the Terms

We may update these Terms from time to time. Any changes will be effective upon posting within the App. Continued use of the App after such changes constitutes acceptance of the revised Terms.
